These Terms of Service explain the conditions for using the Wm. Fox & Co. website and purchasing from our online store. References to “we”, “us” and “our” mean Wm. Fox & Co. Please read these terms together with our Delivery & Returns policy and Privacy Policy.
Using our website
Use this website lawfully and provide accurate information when placing an order or contacting us. You must have the legal capacity to make a purchase and be authorised to use the payment method you provide. You are responsible for keeping your account credentials confidential and should notify us if you believe your account has been accessed without permission.
You must not interfere with the website, introduce malicious software, attempt unauthorised access or use the service for fraudulent transactions.
Products, fit & availability
We aim to describe our merchandise accurately. Colours and textures can appear differently on different screens, and photographs may not show every detail of a garment. If you need advice about sizing, fit, fabric or a particular product, contact us before purchasing.
Availability can change. If we cannot fulfil an item you have ordered, we will contact you about the available options. If an order or item is cancelled by us, any payment collected for the cancelled goods will be refunded as required by law.
Prices & payment
Unless otherwise indicated, prices are in US dollars. Review the order total, including any applicable taxes and delivery charges shown at checkout, before completing payment. For orders arranged directly with us, review the quotation and payment arrangements before accepting them.
If we identify a material pricing or description error affecting an order, we will contact you to explain it and resolve the order. We will not charge an increased price without your agreement. Payment must be made using a method accepted for that order.
Order confirmation
An order acknowledgement confirms that we have received your order; it does not confirm that the goods have been dispatched. Please check your confirmation and contact us promptly if the items, sizes, delivery address or contact details are incorrect.
Custom clothing & alterations
Custom garments and alterations require agreement on the relevant specifications, fit requirements, price and anticipated timing. Please review these details before authorising work and retain your order documentation.
Custom orders and altered merchandise are excluded from our standard return, exchange and store-credit policy. This exclusion does not remove rights that cannot be excluded under applicable law, including rights relating to faulty goods.
Order changes & cancellation requests
Contact us as soon as possible if you want to change or cancel an order. We will confirm whether your request can be accommodated, taking account of the order’s dispatch or production status and your applicable legal rights. A request should not be treated as accepted until we confirm it.
Any deposit, production or cancellation conditions specific to a custom order must be explained and agreed as part of that order. These terms do not introduce a separate cancellation fee.
Delivery, returns & exchanges
Our Delivery & Returns policy explains delivery enquiries and our standard 14-day store-credit and exchange rules. Custom orders and altered merchandise are excluded from the standard policy. Please contact us before sending merchandise back so that we can confirm the appropriate instructions.
If a shipment delay gives you a legal right to cancel and receive a refund, that right is not restricted to store credit. Nothing in these terms limits mandatory consumer protections.
Privacy & communications
Our Privacy Policy explains how personal information is collected, used and shared, including Shopify’s role in providing the store. We may contact you about orders, appointments and enquiries. Where you receive marketing emails, you can use the unsubscribe link to change your email preferences.
Website content & third-party services
Website text, photography, branding and other content belong to Wm. Fox & Co. or their respective owners. You may use the website for personal shopping and information. Commercial reproduction or redistribution of content requires permission from the relevant rights holder.
Our store is hosted by Shopify. Purchases of our merchandise are transactions with Wm. Fox & Co. Links to third-party websites are provided for convenience; those websites have their own terms and privacy practices.
Problems, applicable rights & updates
If you have a concern about the website, a product or an order, contact us using the details below so that we can assist. Your rights and remedies are governed by applicable law, and nothing in these terms excludes rights or liabilities that cannot lawfully be excluded.
We may update these terms by posting a revised version with an updated date. Changes apply prospectively and do not remove rights relating to an order already placed.
